The commercial and operational terms of each engagement are defined in its quotation or contract, which takes precedence in case of conflict.

1. Studio services

PixLake designs and develops websites, web applications, dashboards, mobile applications, video games, interactive experiences and on-device AI solutions. Website descriptions, concepts, prototypes and showcased projects are provided for general information and do not constitute a binding offer or guarantee of availability.

2. Project agreements

A paid engagement begins only when a quotation, statement of work or contract is accepted in writing. That document defines scope, platforms, deliverables, milestones, fees, payment terms, review rounds, acceptance criteria and support. If these website Terms conflict with a signed project agreement, the project agreement controls for that engagement.

3. Estimates, changes and schedules

Estimates rely on the information available when they are prepared. New requirements, platform changes, additional revisions or work outside scope may require a change request, revised schedule and additional fees. Dates depend on timely client decisions, access, materials and third-party approvals.

4. Client responsibilities

The client will provide accurate requirements, authorised contacts, feedback, test devices, accounts, credentials and materials reasonably needed for the project. The client represents that it has the rights and permissions necessary for all supplied names, data, code, music, artwork, brands and other materials. Credentials should be shared through an agreed secure method and rotated when appropriate.

5. Prototypes, previews and acceptance

Prototypes, test builds, development servers, demos and beta versions may be incomplete, unstable or unsuitable for production. They must not be used with unnecessary live personal data or relied on as final deliverables. Review and acceptance procedures are defined in the project agreement; issues reported after acceptance may be handled as support or additional work.

6. Intellectual property in project work

Ownership and licence terms for commissioned deliverables are defined in the applicable project agreement. Unless that agreement states otherwise, transfer of agreed rights occurs only after full payment. PixLake and its licensors retain ownership of pre-existing materials, development tools, engines, libraries, reusable components, workflows, know-how and general techniques. The client receives only the rights expressly granted for those retained materials.

7. Third-party and open-source components

Projects may incorporate operating-system services, engines, SDKs, APIs, fonts, assets, cloud services and open-source software. These remain governed by their respective licences and terms. PixLake will not knowingly grant rights it does not own. Changes, pricing, discontinuation or licence restrictions imposed by third parties may affect a product and may require additional work.

8. Apps, games and platform publication

Submission to the Apple App Store, Google Play, game stores, console platforms or other distribution services is subject to the operator’s accounts, policies, fees, technical requirements and independent review. PixLake cannot guarantee approval, ranking, discoverability, revenue, uninterrupted availability or future compatibility. Unless expressly included, ongoing compliance updates, store maintenance, hosting and live operations are separate services.

9. AI and generated material

Where a project includes AI-assisted or generated material, its permitted use, review process and technical limitations will be addressed in the project scope. Outputs may require human review and may not be unique or error-free. Clients must not provide restricted, unlawfully obtained or highly sensitive data for AI processing unless expressly agreed with appropriate safeguards.

10. Support, maintenance and security

Support, maintenance, hosting, monitoring, backups, compatibility updates and incident response are provided only when included in the project agreement or a separate support plan. The client remains responsible for protecting its accounts, promptly installing delivered updates and notifying PixLake of suspected vulnerabilities without publicly exploiting or disclosing them.

11. Confidentiality

Each party should protect non-public technical, commercial and product information received for an engagement and use it only for the agreed purpose. Separate nondisclosure agreements remain effective according to their terms. Information that is public, independently developed, lawfully received from another source or required to be disclosed by law is not treated as confidential to the extent applicable.

12. Website content, copyright and trademarks

The PixLake Studios name, PixLake logos, visual identity and original website content are owned by or licensed to 6Project Networks LLC and are protected by applicable copyright, trademark and other intellectual-property laws.

Third-party trademarks, logos, product names, company names and brands referenced on this website remain the property of their respective owners. Their use is for identification and informational purposes only and does not imply affiliation, sponsorship or endorsement.

No licence or right to use PixLake intellectual property is granted except as expressly agreed in writing. You may not copy, reproduce, distribute, modify, falsely attribute or commercially exploit protected website materials.

13. Acceptable website use

You may not attempt unauthorised access, probe or disrupt infrastructure, introduce malicious code, scrape the website in a harmful manner, impersonate another person, or use the website to violate law or third-party rights. External links are provided for convenience and remain the responsibility of their operators.

14. Warranties and liability

PixLake performs contracted services with professional care. Except for warranties expressly stated in a project agreement and to the maximum extent permitted by law, the website and general materials are provided “as is.” PixLake does not guarantee that every product will be uninterrupted, error-free or compatible with future third-party changes.

Subject to mandatory law and the applicable project agreement, PixLake is not liable for indirect, incidental, special or consequential loss; lost revenue, profit, data or opportunity; third-party failures; client misuse; unauthorised modifications; or systems outside PixLake’s control. Nothing in these Terms excludes liability that cannot legally be excluded.

15. Termination and survival

Termination rights, outstanding fees, handover and transition assistance are governed by the applicable project agreement. Provisions concerning payment, confidentiality, intellectual property, limitations of liability and dispute resolution survive where their nature requires it.

16. Governing law and contact

These terms are governed by the laws applicable in the State of Illinois, USA, without limiting mandatory consumer rights that may apply in your jurisdiction.
